1. Definitions

In these Terms and Conditions:

• "Agreement" means these Terms and Conditions as accepted by the User.
• "Kithward", "we", "us", "our" refers to Kithward, 64 Chaeng Watthana Road, Thung Song Hong, Lak Si, Bangkok 10210, Thailand.
• "User", "you", "your" refers to any individual or organisation that accesses our website or purchases a Resource.
• "Resource" means any written guide, package, or toolkit offered by Kithward, including the Getting-Started Family Guide, the Records Organisation Package, and the Employer Family Information Toolkit.
• "Content" means all text, layouts, templates, checklists, and other materials contained within a Resource.
• "Service" means the provision of Resources and related support by Kithward.

2. Acceptance of Terms

By using our website, submitting an enquiry, or purchasing a Resource, you confirm that you have read, understood, and agreed to these Terms and Conditions. If you are purchasing on behalf of an organisation, you confirm that you have authority to bind that organisation to this Agreement.

Users must be at least 18 years of age to purchase Resources. Kithward reserves the right to decline orders at its discretion.

3. Description of Services

Kithward provides informational written resources relating to household planning in Thailand. All Resources are strictly educational and organisational in nature and do not constitute legal, financial, medical, or professional advice of any kind. Nothing in any Resource should be construed as a recommendation to take any particular course of action. Families and organisations remain solely responsible for their own decisions.

Resources are available for purchase via our website and are delivered in the formats described on the relevant product pages.

4. Ordering and Payment

Orders may be placed through our website contact form or by direct communication with our team. Upon agreeing to an order, Kithward will issue a payment request. The order is confirmed upon receipt of payment.

All prices are stated in Thai Baht (฿) and are inclusive of applicable taxes unless stated otherwise. Payment methods accepted include bank transfer and online payment methods listed at point of purchase. Kithward does not store payment card data.

5. Delivery

• Digital Resources: PDF downloads and digital toolkit files are issued to the email address provided at order within 1 business day of payment confirmation.
• Printed Resources: Physical booklets are dispatched within 3–5 business days of payment confirmation to the address provided. Delivery times vary by location. Kithward is not responsible for delays caused by postal services or courier partners after dispatch.

6. Refund Policy

Because Resources are informational and delivered digitally, we are unable to offer refunds once a digital file has been downloaded or accessed. For physical booklets, if a booklet arrives damaged or is not delivered within 14 days of dispatch, please contact us at [email protected] and we will arrange a replacement or appropriate resolution.

For employer toolkit orders, cancellation before digital delivery may be considered on a case-by-case basis.

7. Intellectual Property

All Content in Kithward Resources is the intellectual property of Kithward unless otherwise stated. We grant you a limited, non-exclusive, non-transferable licence to use the Resource for your personal household or internal organisational purposes only.

You may not reproduce, republish, resell, redistribute, translate, or create derivative works from any Resource or part thereof without our prior written consent. The Employer Family Information Toolkit includes a bulk internal distribution licence for the purchasing organisation's staff only; this licence does not extend to redistribution to third parties or competing organisations.

8. User Responsibilities

You agree to:

• Use Resources for their stated informational and organisational purposes only
• Not misrepresent the nature of the Content (e.g. presenting it as professional legal or financial advice)
• Not reproduce or distribute Content in ways not permitted by these Terms
• Provide accurate information when placing an order or contacting Kithward

9. Disclaimers

Resources are provided for general informational purposes only. While we take care to keep Content accurate, Kithward makes no representation that the information in any Resource is complete, current, or applicable to your specific situation. Thai laws, regulations, and administrative processes may change, and it is the User's responsibility to verify current requirements with the relevant official bodies.

Kithward is not a law firm, financial adviser, or professional service provider and the Content does not constitute advice of any regulated kind.

10. Limitation of Liability

To the maximum extent permitted by applicable Thai law, Kithward's liability in connection with any Resource or Service is limited to the amount paid by the User for the relevant Resource. We are not liable for any indirect, consequential, or incidental losses arising from use of or reliance on any Resource. Nothing in these Terms excludes liability for death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless Kithward and its team members from any claims, losses, or expenses arising from your misuse of a Resource, breach of these Terms, or infringement of any third-party rights.

12. Termination

Kithward reserves the right to decline future orders or terminate the Service to a User who breaches these Terms. Digital licences may be revoked in cases of material breach, including unauthorised redistribution of Content.

13. Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes arising from these Terms or the provision of Resources shall first be addressed through informal discussion between the parties. If not resolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

14. General Provisions

• Entire agreement: These Terms constitute the entire agreement between the parties in relation to Resources purchased.
• Severability: If any provision is found unenforceable, the remaining provisions remain in force.
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: Kithward may assign its rights under these Terms. Users may not assign their rights without written consent.

15. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be published on this page with a revised "Last Updated" date. Continued use of our website or purchase of Resources after the effective date of any change constitutes acceptance of the revised Terms.
